In England and Wales, 10 year olds may now be criminally prosecuted and acquire criminal records, the lowest age in the EU. In 2012, 2,000 primary-school-age children were arrested in England and Wales leading scientists, ethicists and lawyers to question whether children’s brains are sufficiently developed for them to function as moral agents. More confusingly, the law strictly demands that minors are treated as incapable when it comes to adolescent sex or bullying. So what does it mean to treat children as ‘adults’?
